Marinello ... very similar to your
situation ...
LICENSEE: Neil Marinello
Woodstock, Vermont
LICENSE TYPE: Psychologist Doctorate
VIOLATION: In February 1989, Dr. Marinello agreed to complete a court-ordered evaluation of a mother who was engaged in a child custody proceeding. The Board of Psychological Examiners found that Dr. Marinello failed to file a report to the court that the mother was a danger to other individuals involved in the proceedings and that he had entered into a patient/therapist relationship with both parents and the minor child, which was a conflict of interest. The Board also found that Dr. Marinello willfully filed a false report which accused the father of sexually molesting or abusing the father's minor child. Dr. Marinello did not have proper basis or corroboration to support his accusations. Dr. Marinello also relayed confidential information regarding the father to the minor child's Guardian Ad Litem without the permission of the father.
SANCTION: On November 6, the Board suspended Dr. Marinello's license for four months beginning January 1, 1998. The Board also placed limitations and conditions on his license. He shall not practice psychology in forensic or court-ordered cases, cases involving divorce, child custody and visitation, or cases involving mediation or arbitration. Other conditions were also placed on his license.
